Please read this document carefully. By accessing or using 77 Realty Guru, you agree to be bound by the terms and conditions set forth below. DEFINITIONS


Unless otherwise specified, the capitalized terms shall have the meanings set out below:
Account means and includes the account created on the Site, by the User, in accordance with the terms of the Agreement, registered with and approved by 77 Realty Guru.


Agreement means and includes the Terms and Conditions, Privacy Policy and any other such terms and conditions that may be mutually agreed upon between 77 Realty Guru and the User in relation to the Services.


Applicable Law means and includes any statute, law, regulation, sub-ordinate legislation, ordinance, rule, judgment, rule of law, order (interim or final), writ, decree, clearance, Authorizations, approval, directive, circular guideline, policy, requirement, code of practice or guidance note, or other governmental, regulatory, statutory, administrative restriction or any similar form of decision, or determination by, or any interpretation or administration of any of the foregoing by, any statutory or regulatory authority or government agency or any other authority, in each case having jurisdiction over the subject matter of this Agreement.

Broker means and includes all brokers, channel partners, sales agencies, RERA Registerd Agents and other third parties who/ which negotiate or act on behalf of one person in a transaction of transfer including sale, purchase, leave and license, lease or such other form of transfer in relation to a plot, apartment or building, as the case may be, including marketing and promotion of such plot, apartment or building, for remuneration or fees or any other charges for his services whether as commission or otherwise and incudes a person who introduces, through any medium, prospective parties to each other for negotiations and includes property dealers, brokers, middlemen by whatever name called and real estate agent as defined under the Real Estate (Regulation and Development) Act, 2016.


Computer Virus means and includes any computer instruction, information, data, application or program that destroys, damages, degrades or adversely affects the performance of a computer resource or attaches itself to another computer resource and operates when a program, data or instruction is executed or some other event takes place in that computer resource.


Confidential Information means and includes all information that is not in the public domain, in spoken, printed, electronic or any other form or medium, relating directly or indirectly to, the assets, business processes, practices, methods, policies, subscription plans, publications, documents, research, operations, services, strategies, techniques, agreements, contracts, terms of agreements, transactions, potential transactions, negotiations, pending negotiations, know-how, trade secrets, computer programs, computer software, applications, operating systems, software design, web design, work-in-process, databases, manuals, records and reports, articles, systems, material, sources of material, supplier identity and information, vendor identity and information, User identity and information, financial information, results, accounting information, accounting records, legal information, marketing information, advertising information, pricing information, credit information, developments, internal controls, security procedures, graphics, drawings, sketches, sales information, costs, formulae, product plans, designs, ideas, inventions, original works of authorship, discoveries and specifications, of 77 Realty Guru and/or affiliates or their respective businesses, or any existing or prospective customer, supplier, investor or other associated third party, or of any other person or entity that has entrusted information to 77 Realty Guru in confidence.
Content means and includes any information, all data and information on the Site.


Government Authority means and includes any government, any state or other political subdivision thereof, any entity exercising executive, legislative, judicial, regulatory or administrative functions of or pertaining to government, or any other government authority, agency, department, board, commission or instrumentality or any political subdivision thereof, and any court, tribunal or arbitrator(s) of competent jurisdiction, and, any Government or non-Government self-regulatory organization, agency or authority; having jurisdiction over the Agreement and the Services contemplated under the Agreement.

Information Technology Act means the Information Technology Act, 2000.
DPDP Act means THE DIGITAL PERSONAL DATA PROTECTION ACT, 2023

Intellectual Property means and includes patents, inventions, know how, trade secrets, trademarks, service marks, designs, tools, devices, models, methods, procedures, processes, systems, principles, algorithms, works of authorship, flowcharts, drawings, and other confidential and proprietary information, data, documents, instruction manuals, records, memoranda, notes, user guides, ideas, concepts, information, materials, discoveries, developments, and other copyrightable works, and techniques in either printed or machine-readable form, whether or not copyrightable or patentable, each of which is not in the public domain or would by its very nature fall within public domain.

Intellectual Property Rights mean and include (a) all right, title, and interest under including but not limited to patent, trademark, copyright under the Patents Act, 1970, Trademarks Act, 1999 and Copyright Act, 1957 respectively; any statute or under common law including patent rights; copyrights including moral rights; and any similar rights in respect of Intellectual Property, anywhere in the world, whether negotiable or not; (b) any licenses, permissions and grants in connection therewith; (c) applications for any of the foregoing and the right to apply for them in any part of the world; (d) right to obtain and hold appropriate registrations in Intellectual Property; (e) all extensions and renewals thereof; (f) causes of action in the past, present or future, related thereto including the rights to damages and profits, due or accrued, arising out of past, present or future infringements or violations thereof and the right to sue for and recover the same; (g) any Confidential Information.


77 Realty Guru means and includes 77 Realty Guru (A Subsidiary of RangKaushalya Group), a company Based in Dadar , Mumbai, India. including its officers, directors, employees and representatives along with its Site.

These General Terms & Conditions (hereinafter 'Terms') constitute a legally binding agreement between you and relevant 77 Realty Guru entity (a Subsidiary of RangKaushalya Group) (hereinafter '77 Realty Guru/We/Us/Company') regarding your use of the Portal/Web application/Mobile Application. www.77RealtyGuru.com (hereinafter called as 'Site') and any Services offered or made available by 77 Realty Guru, including delivery of content via the Site or through any mobile or internet-connected device (hereinafter 'Services'). Additionally, these Terms shall be applicable on all subsidiaries of 77 Realty Guru Realty Services Limited and all other other entities/ Services where 77 Realty Guru has significant Control.

Your use of the Site and Services and tools are governed by the following Terms which are incorporated herein. By mere use of the Site, you shall be contracting with 77 Realty Guru. These Terms including the policies constitute your binding obligations and with 77 Realty Guru, therefore, it is imperative that before using the platform you acquaint yourself regarding the applicability and consequential application of these Terms.


When You use any of the Services provided by 77 Realty Guru through the Platform, including Product Reviews, Seller Reviews etc., you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such Services, and they shall be deemed to be incorporated into these Terms and shall be considered as part and parcel thereof.


77 Realty Guru reserves the right to amend or modify these Terms without any prior notice or intimation. Such modifications shall become effective immediately upon being posted on the Site. You are advised to review the Terms periodically to remain informed of any changes. Any further access to the Site after such modifications shall constitute your conclusive acceptance of the revised Terms.

77 Realty Guru also reserves the right to temporarily suspend operations of the Site for maintenance, technical upgrades, content updates, or any other purpose, without prior notice to the user.

Services :


77 Realty Guru provides various internet-based Services through its platform, including:
1. Posting property listings and User profiles for sale, rent, or related Service.
2. Searching for properties via 77 Realty Guru.com and its associated links.
3. Placing print advertisements in group publications through the platform.
4. Posting online advertisements.
5. Sending promotional messages via email, Google Ads, Meta Ads, Whatsapp And SMS.
6. Other Services as mentioned on Site or as stated in these Terms, or any other related marketing activities.
Services may be purchased through available payment options and are subject to applicable policies, including subscription fees, refunds, and cancellations.

USE OF INFORMATION


A. 77 Realty Guru undertakes that the procurement, storage, usage and dissemination of all information including User Information and/or Content, as the case may be, pursuant to this Agreement, shall at all times, including upon expiration of the Services or termination of the Agreement with the User, be in accordance with the Information Technology Act 2000, AND DPDP Act 2023, the rules made thereunder and other relevant Applicable Laws.
B.. The User hereby irrevocably and unequivocally authorizes 77 Realty Guru to utilize User Information for the purposes including those set out below:
(a) provision of Services in accordance with the Agreement;
(b) disclose User Information to its directors, officers, employees, advisors, auditors, counsel, or its authorized representatives on a need to know basis for provision of the Services;
(c) contacting a Third Party Service Provider and/ or facilitating/ enabling the services of a Third Party Service Provider for the User pursuant to the arrangement between 77 Realty Guru and such Third Party Service Provider;
(d) conducting internal studies, consumer research, surveys and preparing reports in connection with the Services;
(e) entering the registration data for an Account or receiving alerts, contacting a property seller/ buyer; and
(f) sending alerts, contact details, promotional messages and promotional calls whether by 77 Realty Guru itself or through its partners/ vendors and sub-partners/ sub-vendors.
(g) disclosing to third parties (including law enforcement agencies and the User’s building management personnel) personally identifiable information where 77 Realty Guru has reasonable cause to believe that the Users are guilty of any Prohibited Conduct.

Tailored Advertising


(a) The User acknowledges and agrees that Third Party Service Providers may use cookies or similar technologies to collect information about the User’s pattern of availing the Services, in order to inform, optimize, and provide advertisements based on the User’s visits on the Site and general browsing pattern and report how Third-Party Service Providers advertisement impressions, other uses of advertisement services, and interactions with these impressions and services are in relation to the User’s visits on such third party’s website.
(b) 77 Realty Guru also permits Third Party Service Providers to serve tailored advertisements to the User on the Site, and further permits them to access their own cookies or similar technologies on the User’s device to access the Site or avail the Services.
(c) The User undertakes and agrees that when accessing the Services from a mobile application the User may also receive tailored in-application advertisements. Each operating system provides specific instructions on the prevention of tailored in-application advertisements.
(d) It is to be noted that 77 Realty Guru does not guarantee the accuracy, integrity or quality of any content provided by such Third-Party Service Provider. Further, the Users interactions with such Third-Party Service Providers found on or through the Services provided by 77 Realty Guru on the Site, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the Users and the Third Party Service Providers. In no event shall 77 Realty Guru be liable for any damages arising out of any interaction between the User and such Third Party Service Provider. The information provided on the Site is provided to the Users on an "AS IS, WHERE IS" basis.

77 REALTY GURU PLATFORM


The Users agree and acknowledge that 77 Realty Guru is only an online platform that allows the Users to interact with each other for the purpose of listing their property on the Site and/or searching for appropriate options. The Users further understand and accept that:
i. The Users are ultimately responsible for choosing and/or interacting with other Users on the Site and 77 Realty Guru is only a facilitator that shall not be held responsible or liable for the selection and/or interaction of the Users with other Users on the Site.
ii. 77 Realty Guru may provide the Users the profile previews of other Users who may be suitable to tender to the requirements of the Users based on information that the Users provide to 77 Realty Guru. Please note that 77 Realty Guru (i) does not recommend or endorse any other User i.e it does not endorse any house owners and tenants registered on the Site; and (ii) does not make any representations or warranties with respect to the other Users or the property listed by them. 77 Realty Guru shall not be liable, for any reason whatsoever, for any disputes amongst the Users and there is no liability on 77 Realty Guru for the consequences that the Users may be subjected to while dealing with other Users on the Site.

iii. Information regarding all the Users and/or any third party whose services the Users avail through the Site as displayed on the Site is intended for general reference purposes only. Such information is mainly self-reported by the Users and/or the third party and may change from time to time or become out of date or inaccurate. The Users are encouraged to independently verify any such information the Users see on the Site with respect to the other Users or the property listed by them.
iv. The Users understand and agree that any interactions and associated issues with the other Users and/or the third parties with whom the Users interact through the Site or the third party whose services the Users avail through the Site including but not limited to any service-related issues, any Prohibited Conduct issue, any fraudulent activity is strictly amongst the Users and/or the third party and the User shall not hold 77 Realty Guru responsible for any such interactions and associated issues. If the Users decide to engage with other Users, the Users do so at their own risk.
v. 77 Realty Guru cannot assure that all the transactions will be completed nor does 77 Realty Guru guarantee the ability or intent of the Users to fulfil their obligations under any transaction. 77 Realty Guru advises the Users to perform their own investigation prior to selecting and/or interacting with the other Users on the Site.

CONTENT ON THE SITE


77 Realty Guru shall endeavor to ensure that the Content on its Site is monitored to ensure that the same is not in contravention of Applicable Law and this Agreement. In this regard, the Users represent and warrant that they shall not do any of the following via the Site or otherwise in connection with the Service:
(i) attempt or help anyone else attempt to gain unauthorized access to the Site or 77 Realty Guru’s related systems or networks (including without limitation the impersonation of another User or use of a false identity or address to gain access to the Site);
(ii) use the Site to violate the Intellectual Property Rights of any person (including without limitation posting pirated music or computer programs or links to such material on Site or on the User’s Profile);

(iii) send spam or otherwise duplicative or unsolicited messages in violation of Applicable Laws;
(iv) send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including material harmful to children or violative of third party privacy rights;
(v) send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;
(vi) interfere with or disrupt the integrity or performance of the Service or the data contained therein;
(vii) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Service or any content contained in or made available through the Service in any way;
(viii) modify or make derivative works based upon the Service or the Content of 77 Realty Guru;
(ix) create internet "links" to the Site or "frame" or "mirror" any Content on any other server or wireless or internet-based device; or
(x) reverse engineer or access the Service in order to (a) build a product competitive with the Service, (b) build a product using ideas, features, functions or graphics similar to those of the Service, or (c) copy any ideas, features, functions or graphics contained in the Service.

USER GENERATED CONTENT

​

The Site may contain user generated content (“UGC”) which 77 Realty Guru does not pre-screen and which contains views that may be opinions of Users and also of experts. These views do not represent 77 Realty Guru’s views, opinions, beliefs, morals or values. 77 Realty Guru does not claim any ownership rights in the text, files, images including photos, videos, sounds, musical works or any UGC that the Users submit or publish on the Site. After posting any UGC on the Site, the Users continue to own the rights that the Users may have in that UGC, subject to the limited license set out here. 77 Realty Guru shall do its best to monitor, edit or remove such UGC where 77 Realty Guru considers it appropriate or necessary to do so. 77 Realty Guru does not promise that the content in or on the Site is accurate, complete or updated, that it will not offend or upset any person or that it does not infringe the Intellectual Property Rights of third parties.
The Users hereby expressly acknowledge and agree that 77 Realty Guru will not be liable for the User’s losses or damages (whether direct or indirect) caused by any activity undertaken by the User on the basis of any UGC.

DISCLAIMER

​

(a) The information and opinions available on the Site in relation to the Services are mere guidelines for the purposes of providing general information on the subject and the exchange of property and any other information through or on the Site is not an offer and/or recommendation from/ by 77 Realty Guru.
(b) The Content should not be regarded as legal, financial or real estate advice for the User. 77 Realty Guru advises the User to make independent enquiries and obtain professional advice before making legal, financial or real estate decisions. The measurements, prices and locations provided on the Site 
are approximate and no responsibility is taken by 77 Realty Guru for any error, omission or misunderstanding in construing those particulars.
(c) The Services are chosen and used at the User’s risk and discretion and 77 Realty Guru makes no representations or warranties, express or implied, to the User in relation to the Services or otherwise regarding this Agreement, including the implied warranties of merchantability and fitness for a particular purpose.
(d) The User understands and acknowledges that the User assumes certain risks prior to interacting with other Users/ persons/ Third Party Service Providers on and through the Site, and the User shall be solely responsible for such User’s personal assessment of specific requirements with regard to interaction with other Users/ persons/ Third-Party Service Providers.
(e) 77 Realty Guru expressly disclaims any liability or responsibility whatsoever and howsoever arising as a result of any Content/ listing posted on the Site/ made available to 77 Realty Guru by any User or any third party or any deficiency in service that is caused to the User due to a Third-Party Service Provider.
(f) 77 Realty Guru does not warrant the Services or the results obtained from the use or that the Services will meet the User’s expectations or requirements or that the Site will be uninterrupted or free from any technical error.
(g) 77 Realty Guru is not responsible for the accuracy or reliability of any third-party reports, market information, studies and analysis made available on the Site and any external web links mentioned on the Site.
(h) 77 Realty Guru does not have the obligation to physically meet, conduct background or police verification of the Users. The terms "genuine verified owner" and "genuine verified tenants/ buyers" on the Site refer to 77 Realty Guru’s algorithm-based technological process by which Brokers are prohibited from accessing the Site and availing the Services. This is on a best-effort basis and has its own limitations. 77 Realty Guru accepts User Information in good faith and shall not be held responsible with regard to the bonafides of the Users.

(i) 77 Realty Guru shall not be liable for any damages, expenses, costs or losses incurring from the User’s engagement in Prohibited Conduct and availing services of Third-Party Service Providers.
(j) 77 Realty Guru shall not be held liable or responsible for indemnifying, refunding or reimbursing any User for any loss, damages or expenses suffered or incurred by such User as a consequence of the suspension or deactivation of the User’s Account.
(k) 77 Realty Guru shall not be liable for any third party fees, costs, charges or expenses incurred by the User for accessing the Site or availing the Services. 77 Realty Guru shall not be liable in respect of any disputes or legal proceedings between the User and such third party for any reason whatsoever and any such disputes or proceedings shall be resolved outside the Site without any reference or recourse to 77 Realty Guru.
(l) 77 Realty Guru neither has access to, nor does the Agreement govern the use of cookies or other tracking technologies that may be placed by Third Party Service Providers on the Site. These parties may permit the User to opt out of tailored advertisement at any time, however, to the extent advertising technology is integrated into the Services, the User may still receive advertisements and related updates even if they choose to opt-out of tailored advertising. 77 Realty Guru assumes no responsibility or liability whatsoever for the User’s receipt or use of such tailored advertisements.
(m) 77 Realty Guru shall not be liable for the non-performance or defective or late performance of any of the Services or any of its obligations under this Agreement to such extent and for such period of time if such non-performance, defective performance or late performance is due to acts of God, war (declared or undeclared), civil insurrection or unrest, acts (including failure to act) of any Governmental Authority, riots, revolutions, fire, floods, strikes, Medical related Lockdowns, lock-outs or industrial action.

GRANT OF RIGHTS TO 77 REALTY GURU’S FINANCE PARTNERS:

​

i. Notwithstanding anything contained herein and in 77 Realty Guru's Privacy Policy, the User authorizes 77 Realty Guru to share with its finance partners, any and all information that the User may provide in relation to the use of the Site for availing the products and/or service of 77 Realty Guru’s finance partners.
ii. By clicking on the "Apply Now/Submit" tab:
(a) The User agrees and authorizes 77 Realty Guru’s finance partners to contact the User and communicate with the User over emails, telephonic calls, or SMS on the mobile number mentioned on the Site, or through any other communication mode, to verify the details provided by the User on the Site or to verify the information provided by the User during registration on the Site.
(b) The User confirms that the User would like to know through the above-mentioned communication modes, about the various offers and promotion schemes relating to various products/services offered by 77 Realty Guru’s finance partners/its group companies, from time to time.
(c) The User further agrees and confirms that the laws in relation to the unsolicited communication referred to in the "National Do Not Call Registry" (the "NDNC Registry") as laid down by the Telecom Regulatory Authority of India will not be applicable for such communication/calls/ SMS received from 77 Realty Guru’s finance partners, its group companies, employees, representatives and/or agents.

(d) The User authorizes 77 Realty Guru’s finance partners to exchange and share all information and details, as provided by the User on the Site, with third parties, including but not limited to 77 Realty Guru’s finance partners' group companies, service providers, financial institutions, credit bureaus, telecommunication companies, statutory bodies, etc., for customer verification, personalization of products or services, credit rating, data enrichment, marketing or promotion of services or related products of 77 Realty Guru’s finance partners or that of its associates and affiliates or for enforcement of the User’s obligations. In this regard, the User agrees that it shall not hold 77 Realty Guru’s finance partners (or any of its group companies or its/their employees/agents/representatives) liable for using/sharing of the information as stated above.
(e) The User understands and agrees that pursuant to this application form, the User will be required to submit documents to the satisfaction of 77 Realty Guru’s finance partners and accept the loan terms and conditions as prescribed by 77 Realty Guru’s finance partners in relation to the products and/or service applied by the User.
“I, as a subscriber/ User of the services offered through the web portal 77 Realty Guru.com, do herby expressly authorize 77 Realty Guru.com and any of their business associates to call/ SMS my/our registered phone numbers (as provided by me / us to 77 Realty Guru.com). I hereby expressly state that such authorization shall override the national Do-Not-Disturb Registry ("DND"), even if the phone numbers in question are registered under DND list of national Consumer preference registry

(NCPR/NDNC). I/we also undertake that I/We will not make any complaints to NDNC for any calls
received from 77 Realty Guru.com services/ products, and shall indemnify 77 Realty Guru.com and any of its business associates for having engaged in any such practice. I realize, acknowledge and expressly authorize 77 Realty Guru.com to make the initial communication (via Call / SMS / E-mail/WhatsApp) for the purposes of confirmation of my credentials provided by me. I hereby authorize 77 Realty Guru.com and its business associates to continue contacting me via any of the modes of communication listed above, till such time as I expressly opt-out / unsubscribe from the service offered by 77 Realty Guru.com. Till such time, 77 Realty Guru.com and its business associates shall have all rights to continue communicating with me and I shall completely indemnify them against any liability that may arise as a result of such authorization to communicate. Such indemnification shall extend to court cases and suits and all lawyer / advocate fees, even if the dispute is never subjected to judicial scrutiny.”

LIMITATION OF LIABILITY

​

77 Realty Guru’s total aggregate liability under this Agreement and in relation to anything which 77 Realty Guru has done or not done in relation with this Agreement shall be limited to the fees paid by the User for availing the Services in relation to which such liability of 77 Realty Guru arises. ',

​

INDEMNITY

​

77 Realty Guru and its Owners, officers, employees and agents collectively at all times shall be held indemnified against any losses, costs, expenses, claims, suits and/or damages (including reasonable attorney fees)incurred and/or suffered by 77 Realty Guru, whether directly or indirectly, resulting from, an act or a failure to act, of any User, person or Third-Party Service Provider for any reason whatsoever and against any claims, suits and/or legal proceedings initiated by third parties inclusive of but not limited to the User’s:
(a) breach of any terms of this Agreement;
(b) third party claims arising from an infringement or alleged infringement of such third party’s Intellectual Property;
(c) claims made by any Government Authority due to the User’s violation of Applicable Law; or
(d) actual or alleged gross negligence or willful misconduct in connection with the User’s use of the Services or this Agreement.
(e) a fraudulent act committed by a User which results in loss or damage, suffered or incurred by any other User or by any third party.

REAL ESTATE REGULATORY AUTHORITY

​

(a) For the purposes of this Agreement and Services related thereto, it shall be deemed that the Users are aware about the rules and regulations in relation to the Real Estate Regulatory Authority (RERA) of the concerned state in India. 77 Realty Guru recommends that the Users periodically visit the concerned RERA website for updates and information in relation to any property listed on the Site, prior to finalizing any deal or transaction.
(b) 77 Realty Guru does not endorse or advertise any property listed on the Site and it shall not be held liable for listing any property on its Site where such property is in violation of the rules made under RERA of the concerned state. Further, it shall not be deemed by the Users that 77 Realty Guru has any connection or relation with the parties listing their properties on the Site.

WAIVER AND SEVERABILITY


i. No failure or delay on the part of 77 Realty Guru in exercising any right or remedy shall operate as a waiver of such right or remedy.
ii. In the event that any of the terms and conditions of the Agreement are declared as invalid or unenforceable by a court of competent jurisdiction, such enforceability or invalidity shall not render the other terms and conditions as invalid or unenforceable as a whole.
iii. The invalid or unenforceable provision shall be construed to reasonably reflect the actual intention of the party (in this case, 77 Realty Guru) while drafting it.


AMENDMENT


(a) 77 Realty Guru shall change, update or modify this Agreement, in whole or in part, without any prior notice to the User, provided, however, that, a notification of such change, updation or modification will be made available on the Site.
(b) The User’s uninterrupted and continued usage of the Services and the Site shall be deemed as acknowledgment and acceptance of the changes, updates or modifications to the Agreement.

GOVERNING LAW AND JURISDICTION


Any action, claim, dispute or difference arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination (Dispute) shall be governed by and construed in accordance with the laws of India and the courts Of Mumbai shall have exclusive jurisdiction over Disputes arising out of this Agreement. Notwithstanding anything contained herein, 77 Realty Guru shall not be restricted or withheld from instituting proceedings in courts/ tribunals of any jurisdiction other than Mumbai that it may in its sole discretion deem appropriate and convenient.
Subscription Fees
1. The applicable Subscription Fees shall be as specified on the "My Subscriptions" page or as notified by 77 Realty Guru from time to time.
2. Subscription Fee liability shall commence from the Date of Commencement.
3. Fees: The User agrees that they may be charged a service charge by 77 Realty Guru for using the Site to use the services by our Company
4. Transaction Limits: 77 Realty Guru may delay, suspend or reject a transaction for any payment(s) for any reason, including without limitation if 77 Realty Guru suspects that the transaction subjects it to financial or security risk or is unauthorized, fraudulent, suspicious, unlawful, in violation of the terms of this Agreement subject to dispute or otherwise unusual.
5. Liability: The Users agree not to hold 77 Realty Guru responsible and/or liable for any issue or claim arising out of any dispute whatsoever between the User and the Processor and/or the User and the User’s bank or financial institution.
6. Additionally, please note that 77 Realty Guru shall not be responsible for any additional fees or charges deducted by the Processors while processing payments in connection with the User’s transaction and 77 Realty Guru disclaims all liability in this regard. Further, the Users may also be subject to additional terms and conditions imposed by such Processors and the Users should review these terms and conditions before authorizing any payments through the Processors.
7. Fraud and restrictions: 77 Realty Guru may ask for additional documents (like Rental Agreement, Owner/Tenant PAN, Maintenance Bill) where it deems necessary, including in case the transaction looks suspicious.
8. The Users acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of the User’s access to and use of the payment Services remains with the Users. If the Users permit or authorize another person to use their 77 Realty Guru account in any way, the Users shall be responsible for the actions taken by that person. Neither 77 Realty Guru nor any other party or Processor involved in creating, producing, or delivering the payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these payments terms.

Payment & Refund clause


1. Payment for Services shall be made on a 100% advance basis. For all Services, 50% of the total order value shall be considered as activation/administration charges. The remaining 50% may be refundable on a pro-rata basis upon cancellation, depending on the extent of Services usage. Any applicable refund shall be processed within 4 to 6 weeks from the date of submission of complete and accurate documentation to 77 Realty Guru. All refund claims are subject to the sole discretion of 77 Realty Guru and shall not be construed as a right.
2. User are required to pay the Subscription Fees within the time period specified in the invoice(s) issued by 77 Realty Guru. Once subscribed, payments are non-refundable and shall be appropriated by the 77 Realty Guru.
3. Subscription Fees are payable by the User upon demand. In the event of any dispute regarding the amount invoiced, the User shall pay the full invoiced amount pending resolution. If 77 Realty Guru subsequently determines that the dispute is valid, any excess amount paid by the User will be refunded without any interest.
4. Any delay by the User in making payments will attract interest on the outstanding amount from the due date until the date of full payment. All payments made through the iOS application are strictly non-refundable under any circumstances, including termination of these Terms for any reason.
5. Refunds, if any, are at the sole discretion of the 77 Realty Guru.
6. User acknowledges and agrees that the 77 Realty Guru at its sole discretion and without prejudice to other rights and remedies that it may have under the applicable laws, shall be entitled to set off the amount paid by a User, against any amount(s) payable by User to the 77 Realty Guru under any other agreement or commercial relationship towards other products/Services.
7. The 77 Realty Guru does not guarantee the accuracy or timeliness of refunds to User bank accounts/cards, due to the involvement of multiple entities and system limitations.

Owner's Services


For Owner's Services: The subscription fee is non-refundable. However, if the property is not linked to the purchased package, 50% of the order amount shall be forfeited as activation/administration fees, and the remaining 50% refunded on a pro-rata basis. Refunds may take 6 to 8 weeks post submission of complete documentation to 77 Realty Guru for processing such refund. If the User is found to be a Builder/Agent instead of a property Owner, the listing shall be deactivated without notice and the amount paid forfeited.


Cancellation


1. 77 Realty Guru reserves the sole and absolute right to refuse, cancel, or withhold the publication of any content on its platform without prior notice. In such cases, applicable cancellation charges shall be payable by the User in accordance with the 77 Realty Guru Cancellation and Refund Policy.

2.Payments made online for Platinum Listing Packages are strictly non-refundable and non-cancellable. In cases where payment is made via cheque or demand draft, cancellations will be accepted only prior to realization of the payment.

SECURITY


1. Transactions on the Site are encrypted and secure. Credit/debit card details are handled solely by authorized payment gateways and not stored by the 77 Realty Guru. This information is supplied by the User directly to the relevant payment gateway which is authorized to handle the information provided, and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with.
2. User must safeguard their usernames and passwords, including changing the password periodically and refraining from sharing it with third party.
3. Access to Services must be through the credential of the User.
4. User acquire no rights over mailbox numbers, User IDs, or codes assigned. 77 Realty Guru may reassign these at its sole discretion without liability for any kind of damages or/and relief or/and any other consequence/s.
5. Loss or theft of login credentials must be reported immediately via email, WhatsApp or other means of communication. User shall remain liable for Services use until such notification is received by 77 Realty Guru.
6. Login credentials are to be used exclusively by the User or the authorized representatives of the User. The User shall take all necessary precautions to prevent unauthorized access or/and leakage of username or/and password being provided by 77 Realty Guru to the User. Use of automated software to extract or download data from the Site is prohibited without prior written consent.
7. 77 Realty Guru shall not be liable for any fraudulent transactions or unauthorized deductions from the User bank account.

Prohibited Actions


1. User shall not permit unauthorized persons to access or use the Services, nor shall they resell, sublicense, assign, or commercially exploit the Services or any listing in any unauthorized manner.
2. The Services must only be used for its intended and subscribed purpose and in compliance with applicable Indian laws, regulations, and platform terms.
3. User are prohibited from posting, transmitting, or storing content that is defamatory, obscene, pornographic, pedophilic, abusive, threatening, harassing, libelous, racially or ethnically objectionable, or otherwise unlawful or harmful.
4. Content that endangers India's sovereignty, security, unity, foreign relations, public order, or promotes incitement of cognizable offences is strictly prohibited.
5. User must not impersonate any person or entity, misrepresent their affiliation, or disclose confidential or proprietary information without proper authorization.
6. Uploading or transmitting viruses, malware, or malicious code; attempting unauthorized access to systems, networks, or the Site; or using bots, scrapers, or similar tools without permission is strictly prohibited.
7. User shall not print, download, delete, amend, or misuse data posted by others, nor shall they use third-party data without consent except for lawful transactions.

8. User must not share false, misleading, or deceptive information, or any content created with malicious intent to harm or misinform others.
9. Sending unsolicited messages, engaging in spamming activities (including redirection from other platforms), or advertising unrelated Services to other users is not allowed.
10. Violation of these Terms may result in suspension, deactivation, or blacklisting of the User account. 77 Realty Guru may also forfeit subscription amounts as liquidated damages to recover losses suffered.

Intellectual Property Rights And Data Usage


1. All intellectual property rights in the Site, Services, property listings, User data, and all related content remain the sole and exclusive property of 77 Realty Guru. User shall have no claim or right over such intellectual property.

2. Any content contributed by a User (text, images, videos, reviews, etc.) shall automatically vest in 77 Realty Guru. Reproduction or reuse of such content elsewhere constitutes infringement, and 77 Realty Guru reserves the right to initiate legal action, including recovery of costs and damages.
3. All trademarks, logos, and brand elements displayed on the Site are owned by or licensed to 77 Realty Guru. No right or license is granted to any User. Unauthorized use shall attract strict legal consequences.
4. 77 Realty Guru enforces third-party intellectual property rights and may terminate access without notice in case of infringement.
5. User are granted a limited, non-transferable, non-exclusive, and revocable license to access and use the Services, strictly in accordance with these Terms.
6. No part of 77 Realty Guru' proprietary content—names, marks, designs, graphics, or creative elements—may be used or reproduced without explicit written consent.
7. 77 Realty Guru reserves the right to use and/or share User-provided data for operational, business, analytical, or marketing purposes, in compliance with applicable law and privacy policy.
8. All data submitted by Users shall remain with 77 Realty Guru even after account suspension or termination. Such data shall be retained exclusively by 77 Realty Guru unless otherwise agreed in writing.

9. By submitting mobile numbers or emails on the Site, User consent to receive calls, messages, or alerts from 77 Realty Guru, its affiliates, partners, and authorized agents, regardless of Do Not Disturb registration.
10. 77 Realty Guru may record and share calls between User and its authorized representatives.
11. User who do not agree to these terms should refrain from submitting their contact details on the Site.

Confidentiality


1. The User acknowledges and agree that, in the course of using 77 Realty Guru platform or Services, you may receive or gain access to certain non-public, sensitive, or proprietary
information relating to 77 Realty Guru, its affiliates, partners, or other users. You agree to maintain the confidentiality of all such information and not to disclose, share, publish, or otherwise make such information available to any third party without the prior written consent of 77 Realty Guru, except where disclosure is required under applicable law, regulation, or legal process.

2. You further agree not to use any such information for your own benefit or for the benefit of any third party, except as strictly necessary for your use of the platform and Services in accordance with these Terms. User shall take all reasonable measures to protect confidentiality and prevent unauthorized disclosure or use of any such information.
3. These confidentiality obligations shall survive the termination or expiration of your access to or use of the platform and Services, for any reason whatsoever.

Amendments


1. The right to amend, vary, or modify the Term contained herein, as well as those in the Services Guide, shall rest exclusively with 77 Realty Guru.
2. The Agreement may be updated, and the Term may change periodically. Any such changes or updates will be posted on the Site. User are advised to visit the Site regularly to review the latest Term. For the avoidance of doubt, the User continued use of the Services shall constitute an acknowledgment and acceptance of the amended Term.
Services Modification, Discontinuation, and Maintenance
1. 77 Realty Guru reserves the right, at its sole discretion, to add, modify, suspend, or discontinue any aspect of the Services, temporarily or permanently, at any time, with or without prior notice to the User. In the case of paid Services, a pro-rated refund may be provided for any unused portion, at the sole discretion of 77 Realty Guru.
2. 77 Realty Guru may also, without assigning any reason and without notice, temporarily deactivate, restrict, or suspend access to the platform or any part thereof to carry out maintenance, upgrades, testing, repairs, or other technical activities necessary for the proper functioning of the Services.

3. 77 Realty Guru shall not be liable to the User or to any third party for any direct or indirect loss, damage, cost, or expense arising out of or in connection with the modification, suspension, or discontinuation of the Services, including during periods of maintenance. No fees or charges paid by the User shall be adjusted, refunded, or rebated in such cases unless expressly agreed by 77 Realty Guru.

1. The Site may display or link to content, Services, advertisements, or goods provided by third-party websites or platforms. Such third-party content is not under 77 Realty Guru control, and 77 Realty Guru is not responsible for its availability, accuracy, content, or privacy practices.
2. Hyperlinks and references to third-party websites are provided solely for User convenience and do not imply endorsement by 77 Realty Guru. Accessing such websites is at the User own risk.
3. 77 Realty Guru makes no warranties express or implied regarding third-party content, Services, or goods. 77 Realty Guru does not endorse or guarantee the accuracy, completeness, reliability, or quality of any such third-party offerings. 77 Realty Guru shall not be held liable for any loss, damage, or harm arising from User access to or reliance on third-party websites, content, or Services.
4. Third-party advertisements on the Site are paid placements and do not constitute endorsements. 77 Realty Guru is not responsible for the advertiser's claims, delivery of goods or Services, or user satisfaction.
5. 77 Realty Guru may recommend or provide access to third-party services, software, products, or tools ("Third Party Services") solely for User convenience. Use of any such Services is strictly between the User and the respective third-party provider.
6. 77 Realty Guru does not control, participate in, or advise on any commercial or contractual relationship between the User and any third-party provider. All such dealings are at the sole risk and discretion of the User.

7. 77 Realty Guru may, under separate arrangements, offer limited support Services to third-party providers; however, such involvement does not establish any responsibility or liability toward the User.
8. 77 Realty Guru makes no representation or warranty about merchantability, quality, availability, fitness for purpose, or performance of any product or Services offered by third-party providers. Listing on the platform does not imply endorsement or affiliation.
9. 77 Realty Guru is not liable for non-performance, misconduct, or breach by any third-party provider and does not guarantee the completion or outcome of any transaction facilitated via such providers.

10. 77 Realty Guru functions only as a digital platform for listing and advertising and does not hold possession, control, or ownership over any third-party goods or Services.
11. 77 Realty Guru shall not be responsible for addressing complaints, disputes, or claims relating to third-party Services. Such matters must be resolved directly with the respective provider.
12. 77 Realty Guru disclaims liability for the unavailability, suspension, or termination of any third-party service at any time.
13. If the User enables or integrates a third-party Services, the User authorizes the third-party provider to access their data solely for functional purposes.
14. 77 Realty Guru shall not be liable for data breaches, corruption, or loss resulting from such integrations.
15. 77 Realty Guru shall not be liable under any circumstances for direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from the User's use of or reliance on any third-party service or provider, even if advised of such risks. These exclusions apply to the fullest extent permissible under law.
16. User agree to indemnify and hold harmless 77 Realty Guru, its affiliates, officers, employees, agents, and service partners from any claims, liabilities, or losses arising out of or related to their use of third-party services or interactions with third-party providers.
17. 77 Realty Guru does not offer refunds for any goods or services purchased from third-party providers through the platform. All refund or grievance claims must be raised directly with the concerned provider.

Termination And Suspension


1. User may request suspension of the Services by submitting a written request to 77 Realty Guru. 77 Realty Guru shall have up to 30 (thirty) days from the date of receiving such request to
review and respond. Any suspension or termination shall be at the sole discretion of 77 Realty Guru and subject to its confirmation in writing.
2. Notwithstanding the above, 77 Realty Guru reserves the right to immediately terminate your access to the Service and/or the Agreement without prior notice if it has reasonable grounds to believe that you have engaged in any activity amounting to fraud, misrepresentation, cheating, or any act prejudicial to the interests of 77 Realty Guru.
3. In the event of termination (whether on your request or initiated by 77 Realty Guru), any fees or amounts paid by you shall be forfeited and shall not be refundable under any circumstances. In case of immediate termination under Clause 2 above, you expressly waive your right to claim any refund, compensation, or damages from 77 Realty Guru.

4. Any provisions of the Agreement which by their nature are intended to survive, including but not limited to confidentiality, limitations of liability, and dispute resolution, shall survive termination of the Agreement.

Suspension of Services


1. If any monies payable by the User to 77 Realty Guru are not paid on the due date, 77 Realty Guru may, without prejudice to any other rights or remedies available to it, suspend the Services provided to the User.
2. When the subscribed Services are suspended, it shall be deemed to be terminated. The termination date shall be as stipulated by 77 Realty Guru, and the User shall be liable for all charges and fees incurred up to that date.
3. Upon subsequent payment by the User of the amount demanded by 77 Realty Guru, 77 Realty Guru may, at its discretion and subject to such terms as it deems appropriate, reconnect the Services.

Violation of Terms

​

1. In the event of a violation of the Terms, 77 Realty Guru, at its sole discretion, may pursue any of its legal remedies, including but not limited to the immediate deletion of any offending material from its site, cancellation of the User account, and/or exclusion of any person(s) who
may have violated any of the Terms. 77 Realty Guru may also seek injunctive relief from any court of competent jurisdiction.

2. 77 Realty Guru may pursue violators under applicable criminal and/or civil laws as per the relevant Acts, Rules, and regulations of the land. The Site will cooperate with any investigation conducted by any Central, State, or local authority, court, or tribunal with competent jurisdiction. Such cooperation may be extended without prior notice to the User.
3. If 77 Realty Guru believes, in its sole discretion, that any advertisement or Services may create liability for 77 Realty Guru, it may take any actions it deems necessary or prudent to minimize or eliminate such potential liability, including disclosing User information.
4. In sum, 77 Realty Guru reserves the right to refuse Services to any User to any time and to remove any listings or advertisements for any reason, without prior notice.

Errors, Inaccuracies And Omissions


1. Occasionally, the Site or the Services may contain typographical errors, inaccuracies, or omissions, including but not limited to those relating to product or Services descriptions, pricing, promotions, offers, or availability. 77 Realty Guru reserves the right to correct any such errors, inaccuracies, or omissions and to modify, update, or cancel any information or orders at any time and without prior notice, including after you have submitted your order or request.
2. 77 Realty Guru is under no obligation to update, amend, or clarify any information on the Site or Services, including pricing information, except as may be required under applicable law. Any reference to an update or refresh date should not be interpreted to mean that all information on the Site or Services has been modified or is up to date.

Disclaimer


1. 77 Realty Guru does not warrant, guarantee, or represent that the Services will meet your specific requirements or expectations, be uninterrupted, timely, secure, or error-free, that any results obtained through the Services will be accurate, complete, or reliable, that the quality of any products, services, information, or other material obtained through the Services will meet

4. 77 Realty Guru operates as an intermediary under Section 2(w) of the Information Technology Act, 2000.
5. The content on the Site is provided without warranties of any kind, views expressed by the User are their own and are not endorsed by 77 Realty Guru.
6. 77 Realty Guru does not guarantee any response, satisfactory or otherwise, to listings or banners displayed on the Site.

7. 77 Realty Guru does not control, influence, or guarantee the quality, quantity, timeliness, or conversion of leads that may be generated from such listings or Services.
8. User are advised to independently verify the authenticity of pre-launch offers. 77 Realty Guru does not endorse investments in projects lacking official sanction.
9. Nothing on the Site constitutes an offer to invest in 77 Realty Guru or its affiliates, nor does it imply any representation about product use or compliance with patents.
10. 77 Realty Guru shall not be liable for any disclosure, error, omission, or inaccuracy relating to user information. All data is accepted in good faith, and 77 Realty Guru is not liable for user authenticity.
11. Once a listing is published, 77 Realty Guru does not guarantee any specific level of response.
12. 77 Realty Guru is not responsible for the quality or performance of Services availed through third-party Services providers on or beyond the platform. User must independently verify and deal with such providers at their own risk.
13. Property descriptions and other content on the Site are for marketing purposes only. It is the sole responsibility of buyers/tenants and agents to verify accuracy.

14. Value estimates provided on the Site are for informational purposes only and should not be relied upon for commercial decisions. User are advised to seek professional advice.
15. 77 Realty Guru shall not be responsible for any delays in message delivery via third-party gateways.
16. User must comply with applicable laws while using the Services. 77 Realty Guru will not be liable for any default in this regard.
17. Platinum Listings are valid for two weeks from activation. Any delay in activation from the User side will not extend the listing period.
18. If you believe any content infringes intellectual property rights, notify 77 Realty Guru promptly.
19. 77 Realty Guru does not exercise editorial control over user-posted content. It reserves the right to remove or modify content to comply with applicable laws or community standards.
20. 77 Realty Guru total liability under the Agreement, whether in contract or tort, shall be limited to the total fees paid by the User in the two months prior to the incident giving rise to the claim.

21. 77 Realty Guru does not endorse or verify the advice or opinions of experts. User must independently verify any information before relying on it.
22. 77 Realty Guru is only a platform for advertisers. It is not a party to transactions between User and is not responsible for performance, breach, or delivery. User must resolve disputes independently.
23. If disputes arise between User, 77 Realty Guru has no obligation to intervene and disclaims any related liability.
24. Under no circumstances shall 77 Realty Guru or its affiliates be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Services or Site.
25. The advertiser must provide the RERA registration number for promoting RERA-registered projects. 77 Realty Guru is only an advertising platform and does not verify such details.
26. Third-party Service are available on the Site. 77 Realty Guru does not warrant or guarantee such Services and disclaims all liability arising from their use.
27. By using third-party Service, you authorize 77 Realty Guru to share your data with those providers. 77 Realty Guru is not responsible for loss or misuse of data by third parties.

28. 77 Realty Guru does not offer investment advice. Information on the Site does not constitute an offer or solicitation. Real estate investment involves risk and should be made after independent due diligence.

Waiver


1. The failure of 77 Realty Guru to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
2. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in such provision, and the remaining provisions of these Terms shall remain in full force and effect.
Entire Agreement
1. The Agreement shall constitute the complete and exclusive agreement between the parties with respect to the subject matter hereof, superseding any prior agreements, documents and or communications regarding such subject matter.
2. The Agreement may only be modified, or/and any rights under it waived, by a written document executed by 77 Realty Guru only.
3. The right to change vary or amend, however exclusively rests with 77 Realty Guru.

Governing Law and Jurisdiction


1. It is clarified that there is no agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between 77 Realty Guru and any User of the Services.
2. The User agrees that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Services or these Terms must be filed within 30 days after such claim or cause of action arose, or it shall be forever barred.
3. All information of whatsoever nature received from the User is provided in good faith and is bona fide. The information is believed to be true and correct and complies with the laws of the land.

4. The Agreement and any dispute or matter arising from incidental use of the Site shall be governed by the laws of India, and the User and Site hereby submit to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.

Acknowledgment and Acceptance of Terms


1. The Terms appearing above constitute the entire agreement between the User (as defined above) and 77 Realty Guru (as defined above) and supersede all previous arrangements and schedules between the parties regarding the subject matter contained herein. By completing the registration process and/or checking the "I have read and accept the Terms box, the User indicates his/her acceptance of this agreement and agrees to be bound by all the Terms as stated above.
2. It is our constant endeavour to make Site an enjoyable and effective experience for all our User. If you observe any material or behaviour that may violate Terms, please write to us. User feedback will go a long way in helping us enhance our Services!
